Terms of Service

1. Overview
These Terms of Service (“Terms”) govern your use of the services provided by SetupLobster (“we,” “us,” or “our”), including in-person OpenClaw installation, configuration, security hardening, and post-setup support (collectively, the “Services”).
By purchasing or using our Services, you (“Customer” or “you”) agree to be bound by these Terms.
2. Services Provided
SetupLobster provides:
- In-person installation and configuration of the open-source OpenClaw software on either Customer-provided or SetupLobster-procured hardware (typically a Mac mini).
- Security hardening, integrations, and workflow configuration tailored to your use case.
- A 14-day hypercare period following implementation to address issues directly related to the initial setup.
- Optional ongoing managed care plans (e.g., Lobster Care) for monitoring, updates, and continued support, billed on a recurring basis.
Important: All Services are currently provided in person in the Los Angeles area only. We do not offer remote installations at this time.
We reserve the right to modify the scope, pricing, and availability of Services at any time.
3. Payment & Refunds
- Implementation fees are one-time charges.
- Managed care plans are recurring monthly charges.
- All pricing is listed on our website and is subject to change.
Refund Policy:
- Implementation fees are non-refundable once the in-person setup has been completed.
- If you cancel prior to your scheduled installation, you are eligible for a full refund.
- If SetupLobster is unable to complete the setup due to circumstances within our control, we will either reschedule at no additional cost, or issue a full refund upon request.
Managed Care Plans:
- May be canceled with 30 days’ written notice.
4. Customer Responsibilities
You agree to the following:
Backups — You are solely responsible for backing up all data, files, and configurations before any setup. SetupLobster is not responsible for any data loss during or after installation.
Access — You must provide physical access to the installation location, necessary credentials and system access, network connectivity, and required hardware.
Accuracy — You are responsible for ensuring all information provided (e.g., hardware specs, systems, workflows) is accurate and complete.
Compliance — You are responsible for ensuring your use of OpenClaw and connected services complies with all applicable laws and third-party terms.
5. Third-Party Software Disclaimer
OpenClaw is open-source software developed and maintained by third parties.
SetupLobster is not the developer, owner, or maintainer of OpenClaw and does not guarantee functionality, security, uptime, or future development.
Any issues arising from OpenClaw itself, software updates, or third-party integrations are outside the scope of our Services and liability.
Use of third-party software is at your own risk and subject to their respective licenses and terms.
6. Hardware Disclaimer
If SetupLobster provides hardware (e.g., Mac mini): It is provided as-is, with the manufacturer’s standard warranty. We are not responsible for hardware defects, failures, or issues after delivery.
If you provide your own hardware: You are responsible for ensuring it meets system requirements. We are not liable for damage to Customer-provided hardware except in cases of gross negligence.
7. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW: SetupLobster and its owners, employees, and contractors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of revenue or profits, business interruption, unauthorized access, security breaches, or third-party failures.
Our total liability for any claim shall not exceed the amount you paid for the specific Service giving rise to the claim.
8. Disclaimer of Warranties
The Services are provided “as is” and “as available”, without warranties of any kind.
We do not guarantee that the setup will be error-free, OpenClaw will run without interruption, or the system will meet all of your specific requirements.
9. Indemnification
You agree to indemnify and hold harmless SetupLobster and its team from any claims, damages, or losses arising from your use of OpenClaw after setup, your violation of these Terms, your violation of any law or regulation, or third-party claims related to your usage.
10. Data & Security
During setup, we may require temporary access to your systems, accounts, and network.
We will not intentionally access, copy, or retain personal data beyond what is necessary to complete the setup.
However: we cannot guarantee absolute security of your systems, and you are responsible for changing credentials after installation.

11. Post-Setup Support
The 14-day hypercare period covers only issues directly caused by the initial setup.
It does not include OpenClaw updates or upgrades, new features or workflows, changes made by you after setup, third-party outages, or hardware or network issues.
Ongoing support requires enrollment in a managed care plan (e.g., Lobster Care).
12. Dispute Resolution
Any disputes shall first be resolved through good-faith negotiation.
If unresolved after 30 days: disputes will be resolved via binding arbitration, administered in Los Angeles, California, under the rules of the American Arbitration Association.
Each party bears its own costs.
All disputes must be conducted individually, not as part of a class action.
13. Governing Law
These Terms are governed by the laws of the State of California.
14. Changes to These Terms
We may update these Terms at any time. Updates will be posted with a revised “Last updated” date.
Continued use of the Services constitutes acceptance of the updated Terms.
